Terms

Template text, not legal advice. Last reviewed [DATE]. Have a lawyer read this before a real client signs anything based on it.

Using this site

You may read this site and contact me through it. Nothing on it is an offer to contract; work is agreed in a written quote, and that quote governs.

The build

  • A quote states a fixed price and a fixed scope, page by page.
  • If the work turns out materially larger than the scope described, I stop and re-quote. I do not add it to the invoice.
  • [DEPOSIT]% is payable to start, the balance on launch.
  • On final payment the site's files and copyright in the finished build pass to you. Third-party fonts, photography and code keep their own licences, which I will list.
  • I keep the right to describe the work publicly only if you agree in writing.

Care plans

  • Plans are monthly, in advance, and not a minimum term.
  • Your domain is registered to your business. I am listed as technical contact so the work can be done. You may transfer it away at any time without my involvement.
  • Hosting and third-party services are bought and managed by me and billed to you as part of the plan. The fee is more than their combined list price, because it also buys the management. I will tell you the list prices on request.
  • Each plan includes a stated allowance of changes. A change is an edit to something that already exists. A new page, section or feature is quoted separately. Allowances do not roll over.
  • Either of us may cancel with thirty days' written notice. On cancellation you receive the complete site as files, your domain stays yours, and I will tell you what each service costs so you can take it over directly.
  • If a plan lapses for non-payment I will give [NOTICE PERIOD] written warning before anything is suspended, and will not withhold your domain or your files in any circumstances.
  • Plan prices may change with [PRICE NOTICE] written notice, which applies from your next renewal.

What I do not promise

Accessibility checks catch the faults that can be found in source, which is a large share of them and not all of them. Passing those checks is not a legal guarantee and I do not offer one. Likewise I can improve how a site is built for search, and nobody can promise a ranking.

Your responsibilities

Copy, photographs and anything else you supply must be yours to use. You are responsible for the accuracy of claims made about your own business, including prices, qualifications and anything regulated in your trade.

Liability

To the extent the law allows, liability is limited to the fees paid in the twelve months before a claim, and I am not liable for indirect or consequential loss. Nothing here limits liability for death or personal injury caused by negligence, or for fraud, because no contract term can.

Governing law

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction.
